Pre-purchase inspection of existing food businesses

If you are looking to buy an existing registered food business, Council strongly recommends that you obtain a Food Act Transfer Inspection Report from Council before you buy the food business.

Moreland City Council offers an pre-purchase inspection service. This service includes an inspection of the food business by Council Environmental Health Officers and a report that details all non-compliant items with the Food Standards Code.

There is a fee for this service. The standard service provides a report within 15 working days. There is also an option to pay a higher fee for a 5-day turnaround for the report.

The current proprietor of the food business must sign a form to release the information.

To request a pre-purchase inspection, download and complete the Request for Pre-Purchase Inspection for Registered Premises form (DOC 86Kb) and submit to Council:

  • Submit the form online
  • Mail to Moreland City Council, Locked Bag 10, Moreland, VIC 3058, or
  • Deliver in person to Moreland Civic Centre, 90 Bell Street, Coburg.

Council Environmental Health Officers will inspect the food business and send you or your solicitor a copy of the report.

After Council issues the report, it is the responsibility of the purchaser and the vendor to negotiate to resolve all outstanding non-compliant items. 

Once the transfer of registration is approved by Council, the new proprietor is legally responsible for ensuring compliance with the Food Act.

Transferring existing food business registration

As part of the process of purchasing an existing food business, you must apply to transfer the registration from the current owner to you.

For class 1 and class 2 premises you need to provide a new food safety program and nominate a food safety supervisor as part of the transfer. See starting a new food business for more information.

To apply to transfer registration, download and complete the Application to Transfer Registration of Food Premises form (DOC 174Kb). Submit the completed application form, with the applicable fee and required documentation for your food business classification to Council:

  • Submit the form online
  • Mail to Moreland City Council, Locked Bag 10, Moreland, VIC 3058, or
  • Deliver in person to Moreland Civic Centre, 90 Bell Street, Coburg.

Council Environmental Health Officers will asses the food business and inform you whether the registration transfer has been granted by Council. There may be conditions that you have to comply with before the registration can be transferred.
